Texas, Other States, Begin Battle Against Obama's Transgender Rules

In their lawsuit, plaintiffs have argued that the Obama administration skirted statutory rules of lawmaking by issuing the guidance, and that school districts would be put under undue stress in reaching compliance.

Some 13 states led by Texas will ask a federal judge Friday to halt the Obama administration's order to allow transgender students in US public schools to use the restrooms of their choice.

Meanwhile, other states last month launched a similar suit to stop the new bathroom policy in public schools.

"They have identified no action being taken against them, no threat of action being taken against them", Benjamin Berwick, an attorney for the U.S. Department of Justice said Friday. The Obama adminstration order hinted at potential loss of federal funding for schools which refused to comply.

The guidelines extend the sex discrimination to transgender students, which is why the case is expected to point out the distinction between gender identity and biological sex.

The state of Texas is leading the charge against President Obama's transgender bathroom policy.

The other states filing the complaint are Alabama, West Virginia, Wisconsin, Arizona, Maine, Tennessee, Louisiana, Oklahoma, Utah, Georgia, Kentucky and Mississippi. The lawsuit targets various federal letters, guides, memos, and statements regarding Title IX of the Education Amendments, Title VII of the Civil Rights Act and the Occupational Safety and Health Act (OSHA) that conclude that federal bans on sex discrimination encompass gender identity discrimination and that individuals should be allowed to access single-sex, multi-user facilities consistent with their gender identity.

The mother of a young boy pretending to be a girl is fighting a Texas school district over transgender "rights".

Judge O'Connor did not immediately decide to do so Friday, but said he would try to rule as soon as possible: "Rest assured I'm working on it".

There have been some reports of lawmakers suggesting that transgender people could be beaten, if they do enter the "wrong" restroom, which has only created more anger against the law.
