Trump administration to lift transgender bathroom guidance

President Barack Obama issued the directive "to create and sustain inclusive, supportive, safe and non-discriminatory communities for all students".

The Trump Administration is rescinding guidelines that instructed schools to treat transgender students "consistent with the student's gender identity" when it came to access to restrooms and other facilities.

During the press briefing, Spicer told reporters that President Trump believes the matter should be decided by the states.

"The president's made it clear throughout the campaign that he's a firm believer in states' rights and certain issues like this are not best dealt with at the federal level", Spicer said today.

Former White House spokesman Josh Earnest said at the time that the White House issued the guidance in a response to parents, teachers and students nationwide as school administrators were more concerned with preventing "discrimination" against its students than partisan politics.

The nation's top LGBTQ rights organization is taking a pre-emptive swipe at the Trump administration after news outlets reported that the U.S. Department of Justice and Department of Education are poised to rescind guidance that outlines schools' obligations to transgender students under Title IX of the Education Amendments of 1972.

Donald Trump originally said transgender students should be able to use whichever bathroom they felt was appropriate, but changed his mind after Republican backlash.

The Trump Administration undoing the guidelines previously set forth by the Obama Administration creates discrimination that could actually lead to trans kids hurting themselves. The case involves transgender student Gavin Grimm, who sued the Gloucester County School Board for diverting him from the boys' bathroom to using a janitor's closet converted into a bathroom.

"I think we have to help people", Trump said. In planning to rescind federal guidance protecting transgender students, the new administration is saying to this group of students, 'Protecting you against harassment and abuse is not one of our priorities.' That is shameful and a call to action for all NY educators.

As Spicer mentioned, Trump has also said that this issue should be left to the states, which would effectively let conservative states continue to allow discrimination against trans kids in schools. In the conversations surrounding the language of Trump's forthcoming guidelines, DeVos urged the administration to include anti-bullying protections for transgender students.

The letter, according to the Post, mentioned that schools must protect all students and that the withdrawal of the guidance "does not diminish the protections from bullying and harassment".

When the U.S. Court of Appeals for the Fourth Circuit ruled in the youth's favor, it did not rule directly on what Title IX means, but it chose to accept the Obama Administration's views that sex discrimination under that law also means discrimination based on gender identity.
