Trump administration won't appeal travel ban block, revised immigration order planned

Donald Trump

It led to massive protests and was put on hold by a federal appeals court. But is it unreasonable or unconstitutional? The States maintain that the Executive Order violated the establishment and equal opportunity clauses as it disfavors the Muslims. Second, the order does not use the word "Muslim" even once. When it comes to many of his proposed policies - deporting 11 million undocumented immigrants, reauthorizing torture or a ban on Muslims entering the country - the ACLU said simply: "See you in court". He lives in the United Arab Emirates and had received a temporary visa to marry his childhood sweetheart in the United States.

Trump has said his directive, issued last month, was necessary to protect the United States from attacks by Islamist militants, barred people from Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen from entering the country for 90 days.

White House officials have indicated that a new order would most likely be created to have no impact on current holders of USA visas, meaning that people who hold green cards or have student or work-related visas would be able to travel freely.

The Justice Department said when the new executive order is issued, the Ninth Circuit ruling should be vacated, calling it "seriously flawed in several important respects".

The appeals court countered that no one from the countries committed a terror attack in the United States. Three judges unanimously rejected the government's request to lift the suspension order against the EO by reason of national security. It may have barred an additional 64,000 admitted refugees from entering the country.

Those terrorists - from Iraq - were undoubtedly among the 19 Iraqis listed in the report who were convicted of terrorism. "But we are tailoring it now to the decision", Trump said. For instance, in 2012, the U.S. Supreme Court overturned a whopping 86 percent of the cases it reviewed from the Ninth Circuit Court.

The nation's former intelligence chief, James Clapper, has told Congress that USA agencies are confident Russian Federation interfered in the presidential election that Trump won, and that the former Cold War foe an "existential threat" to the nation, but there's no way to know if Russia's meddling swayed the election.

A legal brief named "Friend of the court" was submitted by 97 companies opposing the Trump administration's immigration order, including several technology giants such as Apple, Facebook, Google, Microsoft, Netflix, Twitter, and Uber stated that the order was a "significant departure" from USA immigration policies and "makes it more hard and expensive for US companies to recruit, hire, and retain some of the world's best employees".

The president says at a news conference that he was "not happy" with how information about Flynn's phone call to a Russian diplomat was relayed to Vice-President Mike Pence. The appeals court should not reconsider the ruling, they said. Refugees are also suspended from being admitted to the country.

Trump has already partially exercised this option in his first executive order when he lowered the annual ceiling from 110,000 refugees set by Obama to 50,000.

The case had generated filings by interested parties ranging from civil liberties groups and legal scholars supporting the efforts of Washington and Minnesota to Texas Attorney General Ken Paxton, who argued in a brief filed Wednesday that the judges are usurping President Trump's authority and improperly granting rights to foreigners that should be limited to American citizens.

Trump has said his directive, issued last month, was necessary to protect the United States from attacks by Islamist militants. Since the very safety of the nation is at stake, it is a good thing that the president has other legal options.
