Homeowner arrested after fatally shooting intruder he found in his shower

A Washington state homeowner has been charged with murder for shooting dead an intruder who had broken in and was using his shower

That is when Fanning went to another building on his property, returned to the shower, and shot Rosa, police said.

Fanning was arrested on suspicion of second-degree murder, but Dorsey will decide what, if any, charges to file.

Fanning said that when he arrived at the office, he found 31-year-old Nate Rosa showering in the bathtub. Police say that Fanning had time to call 911 before returning to the abandoned house to kill Rosa.

"He returned home, retrieved a firearm, came back over to the residence and fired multiple rounds into the shower ... killing the intruder", Mason County Sheriff's Lt. Travis Adams told ABC affiliate KOMO.

While not citing any specific evidence, local law enforcement said there is "more to the story".

Fanning could face a charge of first-degree murder.

"If he had time to leave and get a gun, he had time to call the police, this guy should be locked up", another user wrote. When he found Rosa had not left, he told investigators he shot him three times through the shower curtain.

The Belfair, Washington homeowner was arrested after reporting the April 1 incident at his business.

A magistrate set Fanning's bail at $250,000 and scheduled the man's court appearance on Monday.

The intruder was killed, officials say. According to Spurling, "Based on what he knew at the time and what he told us, it didn't fit self-defense".

He's been in custody at the Mason County Jail since his arrest and the sheriff's office has since referred the case to Mason County Prosecutors, which will decide whether to formally charge Fanning.

Maybrown told the Times that Washington's law doesn't impose a duty to retreat, but a person defending himself is barred from using 'more force than necessary'. Fanning called authorities after the shooting.
