Indiana's AG urged to appeal abortion ruling

Reproductive rights advocates called the draconian bill, known as HEA 1337, "one of the worst anti-abortion laws in the country".

U.S. District Judge Howard Sachs in Kansas City, Mo., on April 4 granted a motion by Planned Parenthood to block longstanding laws requiring abortion doctors to have local hospital privileges and that abortion clinics be licensed as ambulatory surgical centers.

Missouri's GOP-led Legislature has long supported efforts to limit abortion access in the Show-Me state. Some 26 states also have regulations controlling ultrasounds and abortions, and three require that an ultrasound be performed at least 24 hours before an abortion.

The judge, who heard arguments in the case in November, found that in had presented "no compelling evidence" to support its contention that the mandate would further its stated interest of convincing women not to have an abortion.

The ruling states that prior to the new ultrasound laws, women in the state were still required to undergo an ultrasound before an abortion, however, they were allowed to have it done the same day before the abortion and were not required to view the ultrasound. In fulfilling its mission of compassionate care, no matter what, Planned Parenthood provides a safe space where a woman can decide whether continuing a pregnancy, ending a pregnancy or seeking a referral for adoption services is the best option for her health and family.

There was no immediate statement on the decision from Indiana Attorney General Curtis Hill, and no word on whether the state would appeal.
