Indiana's AG urged to appeal abortion ruling

Governor Terry Branstad

Reproductive rights advocates called the draconian bill, known as HEA 1337, "one of the worst anti-abortion laws in the country".

U.S. District Judge Howard Sachs in Kansas City, Mo., on April 4 granted a motion by Planned Parenthood to block longstanding laws requiring abortion doctors to have local hospital privileges and that abortion clinics be licensed as ambulatory surgical centers.

Pratt said that IN also failed to justify mandating that women make two separate trips to abortion clinics. Judge Pratt noted that about 75 percent of Planned Parenthood of Indiana & Kentucky patients had incomes at or below 200 percent the federal poverty line.

In the 53-page ruling, Pratt found that the 18-hour waiting period "creates an undue burden on a woman's right to choose to have an abortion and is therefore unconstitutional".

A preliminary injunction has been granted against the provision.

Missouri's GOP-led Legislature has long supported efforts to limit abortion access in the Show-Me state. Some 26 states also have regulations controlling ultrasounds and abortions, and three require that an ultrasound be performed at least 24 hours before an abortion.

Governor Terry Branstad is advising his fellow Republicans to avoid passing an abortion ban that would prompt a lengthy court battle and, perhaps, never take effect. He works as an Online Marketing Consultant for, providing web marketing services for clients in Albany, Goldsboro.

The judge, who heard arguments in the case in November, found that in had presented "no compelling evidence" to support its contention that the mandate would further its stated interest of convincing women not to have an abortion.

There are six Planned Parenthood locations that provide the ultrasound services, meaning women who do not live near the centers have to travel to reach them, which could be costly, Pratt wrote.

The ruling states that prior to the new ultrasound laws, women in the state were still required to undergo an ultrasound before an abortion, however, they were allowed to have it done the same day before the abortion and were not required to view the ultrasound. "It's a major victory for Planned Parenthood". "It's a major victory for Planned Parenthood", Ken Falk, legal director at ACLU in IN, told members of the media at a news conference on Monday.

ACLU of IN legal director Ken Falk calls it a "strong" decision.

In fulfilling its mission of compassionate care, no matter what, Planned Parenthood provides a safe space where a woman can decide whether continuing a pregnancy, ending a pregnancy or seeking a referral for adoption services is the best option for her health and family.

There was no immediate statement on the decision from Indiana Attorney General Curtis Hill, and no word on whether the state would appeal.
