What is "judge shopping"? Here's what Trump was tweeting about

President Donald Trump misstated how the federal court system works in a trio of tweets Wednesday about a judge who blocked his order to penalize cities that don't cooperate with USA immigration officials.

In a series of tweets, Trump said: "First the Ninth Circuit rules against the ban & now it hits again on sanctuary cities-both ridiculous rulings. But we are confident we will ultimately prevail in the Supreme Court, just as we will prevail in our lawful efforts to impose immigration restrictions necessary to keep terrorists out of the United States".

In a series of tweets, Trump vowed that the White House was ready to bring the case to the Supreme Court and blasted the US 9th Circuit Court of Appeals, which was part of legal decisions blocking Trump's travel restrictions on several Muslim-majority countries.

"The rule of law suffered another blow, as an unelected judge unilaterally rewrote immigration policy for our nation", the statement said.

A federal judge in San Francisco made the ruling on Tuesday after San Francisco and Santa Clara County asked the courts to intervene, arguing that more than $1 billion was at stake for each of them. U.S. District Judge Derrick Watson in Hawaii and U.S. District Judge Theodore Chuang in Maryland said comments by Trump supported the allegation that the ban was aimed at Muslims.

San Francisco and Santa Clara County argued that the administration warning threatened billions of dollars in funding for each of them, making it hard to plan budgets.

If Trump is right about the ultimate destination of the sanctuary cities case, he'll face a court reinforced by his own nominee, conservative Justice Neil Gorsuch. But the Justice Department sent letters last week advising communities to prove they are in compliance.

Orrick said Trump can not set new conditions on spending approved by Congress.

If he wants to take his case to the Supreme Court, he will have to through the 9th U.S. Circuit Court of Appeals first. In the term that ended in 2015, 10 appellate circuits, including the one on which Gorsuch was serving, had reversal rates higher than the 9th Circuit.

Somerville Mayor Joe Curtatone is apparently keeping score in the ongoing skirmish between President Donald Trump and so-called sanctuary cities. "Federal funding that bears no meaningful relationship to immigration enforcement can not be threatened merely because a jurisdiction chooses an immigration enforcement strategy of which the President disapproves".

"The ruling is good news", Michael Ryan said, assistant city attorney in the Seattle City Attorney's office.
