Cosby's team attacks judge likely to retry him in sex case

Judge Steven O'Neill, of the Montgomery County Court of Common Pleas, declared a mistrial on Saturday morning following a note from jurors saying that they were hopelessly deadlocked on three counts of aggravated sexual assault.

NY lawyer Paul Callan, a former prosecutor, said he thinks it will be "exceptionally difficult" for the state to win a second trial against Cosby.

A retrial will likely offer major advantages to the defense, former prosecutors and defense lawyers say, but the enormous publicity surrounding the case may also produce a second jury that is more eager to convict. "Heinously and exploitively ambitious", Cosby's statement began. How do I describe the judge? The district attorney at the time declined to press charges, citing insufficient evidence. Cosby's trial ended without a verdict after jurors failed to reach a unanimous decision.

Cosby, who has been described as legally blind, has been supported by longtime friends and a few actors, including Keisha Knight Pulliam, who played Cosby's TV daughter, Rudy, on "The Cosby Show", which remained popular as the show continued to be shown as reruns long after the TV series ended in 1992. She continued to trust him even after he touched her inappropriately on one occasion.

"I f the court allows more accusers to testify next time, it might make a difference", said Gloria Allred, who represents Kelly Johnson, the only other alleged victim allowed to testify at this trial.

The outcome denied vindication to either the defendant or the dozens of women who have accused Cosby, one of the world's best-known entertainers, of assaulting them over a span of decades. However, it was Andrea Constand whose legal challenge put Cosby in real trouble.

Constand, then 31, met the married Cosby 15 years ago through her job as an administrator with the women's basketball team at Temple University in Philadelphia, where Cosby was a trustee and the school's most renowned alumnus. Later in January 2004, Cosby allegedly assaulted her.

Cosby's defense lawyers, however, argued that Constand's account could not be trusted after they pointed to numerous discrepancies in her statements to police in 2005, when she first reported the encounter, which occurred almost a year earlier. "The jurors, they used their power to speak". The judge instructed them to keep working, but despite marathon 12-hour sessions, the jury said on Saturday it was at an impasse.

Some on social media took issue with Wyatt's victorious reaction to the mistrial.

"It became a great concern of mine that these people had deliberated longer than the case has tried".

Both Camille and the publicist may have forgotten that there are some 50 women who have accused the once-beloved TV staple of sexually assaulting them.

Cosby remains on $1 million bail over the three felony charges.

The case was the only one to result in a criminal trial, largely because the other accusations were too old to prosecute.

However, prosecutors said they would retry Cosby and he still faces a slew of civil lawsuits.
