Trump's transgender military ban challenged by civil liberties groups

In Friday's update, Trump coordinated the divisions of Defense and Homeland Security "to decide how to address transgender people as of now serving" and to stop the utilization of assets to finance "sex-reassignment surgical techniques".

Trump's decision appealed to some in his conservative political base while creating uncertainty for thousands of transgender service members, many of whom came out after the Pentagon said in 2016 it would allow transgender people to serve openly.

Regarding military personnel who have already "transitioned" and are now serving, Trump is leaving it up to Mattis to decide if they will be allowed to stay until their duty is over or if they are to be forced out.

Basically, the lawsuit argues kicking transgender people out of the military breaks the Constitution's mandate that they be treated the same as everyone else under the law.

The ACLU is the same national organization that helped stall Trump's proposed ban against travelers from several Muslim countries, a narrowed version of which took effect in June pending a U.S. Supreme Court hearing in October.

"The Trump organization has given no confirmation that this declaration depended on an investigation of the genuine cost and interruption professedly caused by permitting men and ladies who are transgender to serve transparently", ACLU attorneys said.

Civil liberties groups are taking President Trump to court over his reversal of an Obama-era directive, officially banning transgender military members from serving in the armed forces.

The ACLU says that in addition to the plaintiffs included in its suit, they've been hearing from transgender individuals intending to enlist in the military as well as those who now serve whose gender reassignment surgeries will be cancelled under the ban's provisions. Lambda Legal and OutServe-SLDN [press release] filed a complaint [text] in the US District Court for the Western District of Washington on behalf of a current army Staff Sergeant, two transgender individuals who wish to serve in the military, Human Rights Campaign and the Gender Justice League.

The ACLU argues that the ban is discriminatory and violates constitutional guarantees of equal protection.

According to a Rand Corp study issued past year, there would be "minimal" effect on readiness, with only 10 to 130 active-duty members having reduced deployability because of gender transition-related treatments, the ACLU's suit says.

The new litigation comes on the heels of a policy memo from the San Francisco-based Palm Center, which disputes reports in the media that Trump's transgender policy is a watered-down version of an outright ban. Transgender individuals to serve in any capacity in the U.S. Military. "The most they can decide are the individual fates of now serving transgender personnel, whose presence will be inconsistent with new military policy".

The second case was filed in Seattle by Lambda Legal, a group of lawyers fighting for gay rights, and OutServe-SLDN, which advocates for equality in the military.
