EPA's Scott Pruitt Announces Repeal Of Clean Power Plan

On Monday, U.S. Environmental Protection Agency Administrator Scott Pruitt said he would officially overturn the plan today.

EPA issued a 43-page draft document, where it argued that the Clean Power Plan was "illegal". The executive order was to promote the developing USA energy sources and reduce regulation.

Both of West Virginia's senators, Republican Shelley Moore Capito and Democrat Joe Manchin, issued statements supporting Pruitt's announcement. "Trump runs quickly in the direction of lining the pockets of fossil-fuel industry tycoons, and it's reckless". Martin Heinrich, D-N.M., also attacked the rollback on Monday. "Indeed, this action, together with the nationwide stay of the Clean Power Plan that Murray Energy Corp. received from the Supreme Court of the US, has saved over 25,000 American jobs", Murray spokesman Gary Broadbent said. Yet the plan has always been under fire by fossil fuel interests. Last year, the Supreme Court put the brakes on it after energy-producing states complained that the agency had exceeded its legal reach.

Based on these trends, the Rhodium Group found power sector emissions would fall "27% to 35% below 2005 levels - bookending EPA's target for the CPP" despite the repeal.

A potential sticking point could be the EPA's failure to provide a concrete replacement plan on how to regulate emissions of carbon dioxide.

"The damage caused by Trump's willful ignorance will now have myriads of human faces because he's proposing to throw out a plan that would prevent thousands of premature deaths and tens of thousands of childhood asthma attacks every year", Brune said. Under the Obama rule, the EPA decided on state standards and implementation, the Trump EPA contends.

Trump, who made repealing regulations a centerpiece of his campaign, issued an executive order in March to block the Clean Power Plan.

In February the U.S. Supreme Court stayed the CPP until the lawsuit was addressed.

"No matter who is in the White House, the EPA is legally required to limit risky carbon pollution, and the Clean Power Plan is an achievable, affordable way to do that", said Sierra Club Executive Director Michael Brune.

Today's move to dismantle the CPP is just the latest step toward fulfilling Trump's campaign promise regarding the EPA: "The Department of Environmental Protection-we're going to get rid of it in nearly every form". As communities across the nation this week are reeling from the recent series of massive hurricanes and deadly wildfires, the administration continues to signal its aversion to addressing an important piece of the puzzle: climate change.

The final rule is the result of unprecedented outreach to states, tribes, utilities, stakeholders and the public, including more than 4.3 million comments EPA received on the proposed rule.

Massachusetts Attorney General Maura Healey has pledged to sue the Trump administration over the change, which she says violates the law and imperils the planet. It also aims to transition from coal-based energy to wind, solar and natural gas power.
