Ohio judge orders chatty defendant's mouth taped for sentencing

A judge in Cleveland ordered two pieces of tape to be placed over a defendant's mouth because he would not stop talking during sentencing Tuesday.

Williams was convicted in December of aggravated robbery, kidnapping, theft, misuse of credit cards and having weapons under a disability, according to court documents.

According to the Daily Mail, Williams spoke over the judge and ignored multiple warnings to remain quiet.

Video of the incident shows Williams surrounded by police as one applies a thick piece of red duct tape over his mouth.

"But you're not letting me tell you what's going on", Williams says.

Russo ultimately sentenced Williams to 24 years in prison. He even tried to flee to Nebraska, breaking off his ankle bracelet before his date at the Cuyahoga County Common Pleas Court.

"Just put the tape on me man and get it over with", Williams said. "You got it?" the judge said.

When Williams continued to defy the judge's orders, Russo ordered his mouth to be taped shut.

A video clip from the trial, which took place on Tuesday, July 31, showed the 32-year-old attempting to plead his case to Judge John Russo, before being granted permission to do so. But we can't do it at the same time or yelling over each other.

"Does the comment, 'quit talking, ' do you understand that?"

"Mr. Williams, I'm the judge in the matter", Russo said.

In the 1970 case IL v. Allen, the justices unanimously decided that defendants do not have an absolute right to even be present at their trial, let alone speak at it.

"He would have his time, as I did, I gave him an opportunity to speak when it was an appropriate time", Judge Russo said. "Zip it until I give you a chance to talk".

But he won an appeal, and retrial, after the court accepted he had been misinformed about when he would be eligible for release if he admitted the offenses.

In any other circumstance, Williams would be held in contempt of court.
