Apple to update iPhone software after threat of China ban

Since the ban went into effect, Apple has argued that it does not apply to any of the iPhones it now sells due to the fact they run iOS 12, not iOS 11.

"Early next week we will deliver a software update for iPhone users in China addressing the minor functionality of the two patents at issue in the case", Apple said in a statement.

CHIPMAKER Qualcomm is asking courts in China to ban sales of Apple's latest iPhone XS, XS Max and XR smartphones.

Qualcomm, a leading chip making company on Thursday has urged the Chinese courts to impose a ban on the sales of Apple's new 2018 iPhones models.

Apple argues the injunction should be lifted as continuing to sell iPhones does not constitute "irreparable harm" to Qualcomm, a key consideration for a preliminary injunction, the copy of its reconsideration request dated Dec 10 shows.

Apple also emphasizes the notion that an iPhone ban in the country could cost it millions of dollars per day and would also impact the Chinese government and consumers. In a statement to Reuters, Apple said, "to address any possible concern about our compliance with the order", they will provide an update to all the infringed devices.

Ultimately, it will be up to the Chinese courts to decide if this future software update will be enough to avoid the sales ban. This ban was a result of victory to Qualcomm in winning a preliminary junction in the court. But Apple's response underscores the importance of a Chinese market that generates about a fifth of its revenue, at a time demand for Apple's signature device is slowing.

The case against Apple is basically a part of a global patent dispute between the two tech giants which comprises of several lawsuits. Apple claims that the current version, iOS 12, doesn't infringe Qualcomm's patents-though Qualcomm denies this. "We will pursue all our legal options through the courts".

The ban comes as the trade war between the U.S. and China rages on.
