On Friday, Trump made the national emergency declaration in his latest bid to obtain billions of dollars to fund the wall he has long pledged to build along the USA border with Mexico.

Trump declared the national emergency on Friday to use money from the Pentagon and federal counterdrug programs to meet his campaign promise of completing the wall, without needing congressional approval for funds.

Filed by consumer watchdog group Public Citizen in the U.S. District Court for the District of Columbia, the 19-page lawsuit is likely the first of many legal challenges to be brought against Trump over his efforts to use the executive branch's congressionally-gifted national emergency powers in lieu of legislative methods to fund and construct the border wall.

On Sunday, California Attorney General Xavier Becerra said he was working with officials from at least six other states and would be filing a suit against the White House "imminently". Currently, House Democratic leaders are planning to block the declaration.

Opponents of the declaration also are certain to use Mr Trump's own words at his Rose Garden news conference to argue that there is no emergency on the border. "Now, whether we have enough for an override and veto, that's a different story".
