Refugees should not have to pay fee to seek asylum: U.N.

President Donald Trump's order yesterday to resume requiring asylum seekers to pay a fee for their case to be heard brought a spate of condemnation from the mainstream media.

The White House has not yet established a specific fee for asylum claims, and the memo does not ask that the orders be followed on immediately. But that is not the case. The current capacity of the US immigration system, however, can not meet the demand of individuals defending themselves against removal - both asylum seekers and other undocumented immigrants. As such, they are caught in a triple whammy.

"Our nation has had a long and proud history of providing humane treatment to and due process for asylum-seekers", he said. But seeking asylum, spokesman Charlie Yaxley said, "is a fundamental human right, and people should be allowed to exercise those rights when seeking to seek asylum".

The foundation of worldwide refugee law is the prohibition on sending refugees back to face threats to their lives or freedom; it is not reserved for those who can pay. The president's actions also follow the resignation of Kirstjen Nielsen as secretary of homeland security, which reportedly came after she declined Trump's request to stop accepting asylum seekers altogether.

Trump often mocks the asylum system, calling it a "loophole" that attracts immigrants to the U.S. This memo is the Trump administration's latest effort to make it harder for migrants to stay in the country, and it comes amid a spike in border crossings, including a large number of families seeking asylum. The callousness of this proposal is surpassed only by its pettiness. "They've fled violence-ridden homelands, often arriving at the US border deep in debt, paying $7,000 or more to smugglers", Merchant and Long wrote.

And he is directing officials to begin charging a fee to process asylum and employment authorization applications - which don't now require payment.

As part of the memo, Mr. Trump is giving officials 90 days to come up with new regulations to ensure that applications are adjudicated within 180 days of filing, except under exceptional circumstances.

"That emergency continues to grow increasingly severe", the memo read.

He called on officials to immediately revoke work authorizations when people are denied asylum and ordered removed from the country.

Given the current backlog of over 820,000 pending immigration court cases, it is unlikely President Trump's order will have a significant impact without directing more resources to DHS and DOJ. But he has also emphasized the importance of aid to Central American countries - even though Trump cut State Department funding to Honduras, El Salvador and Guatemala this year.
